Terms of Service

These Terms of Service apply to all purchases made on and any use of the website www.molimentihair.com. By placing an order on this website, you agree to the terms published at the time of your purchase and confirm that the information you provide is accurate. These terms constitute a binding agreement between you and Ombray Media AB, registration number 559043-5003, Lojovägen 88, 181 47 Lidingö, Sweden (hereafter referred to as “Molimenti,” “we,” or “us”). We recommend reading these terms carefully before using the website or completing a purchase.

Contract Formation

This website is intended for adult consumers. When you complete your order, an order confirmation and invoice will be sent to the email address you provided. It is your responsibility to ensure that the email address is entered correctly. The confirmation includes all relevant details, such as product names, prices, and your billing and delivery address. We recommend that you save the confirmation for future reference. If you do not receive a confirmation or if anything in it is incorrect, please contact our customer service immediately.

The order confirmation serves as your proof of purchase.

Prices and Payment

All prices listed on www.molimentihair.com include VAT as required by applicable law. Prices do not include shipping charges, which vary depending on your chosen delivery method. The current price for each product is displayed on the website. If a price is clearly incorrect, Molimenti is not obliged to honor the erroneous lower price.

Discount codes cannot be combined with other promotions unless otherwise stated. Molimenti may offer time-limited discounts and campaigns, which can be changed or terminated at any time, including during the promotion period. Such changes apply only to future purchases.

If your order is shipped outside the EU, customs duties and taxes may apply when the shipment arrives in your country. These charges are not included in the product or shipping price and must be paid by you. We recommend checking with your local customs office before ordering.

Molimenti reserves the right to adjust prices and correct pricing errors on all orders, including those already placed. If an incorrect price is discovered, we may cancel the order and refund the amount paid by the most suitable means.

Purchases on our site are secure. We accept payments by credit or debit card and invoice via Klarna, where available. Molimenti reserves the right to reject an order if the selected payment method is not approved. Not all payment methods may be available in all regions, and options shown at checkout depend on your location and the content of your order. Molimenti also reserves the right to modify, add, or remove payment options at any time. All products remain the property of Molimenti until full payment is received.

Shipping and Delivery

Molimenti processes orders with care and ships according to the delivery option you choose at checkout. Available shipping methods and rates are presented before you complete your order.

Delivery times stated on the website are estimates and not contractually binding. Actual delivery times may vary depending on the shipping provider, destination, seasonal volume, or circumstances beyond our control. Molimenti is not responsible for indirect losses or extra costs caused by delivery delays. Orders placed during weekends or Swedish public holidays are processed on the next working day.

If an unexpected delay occurs and you have not been notified, please contact our customer service. Responsibility for the shipment transfers to you once it has been handed over to the carrier.

We reserve the right to change shipping terms and offer free shipping on selected orders or during promotions. These changes do not apply retroactively.

It is your responsibility to enter complete and correct delivery information. If a shipment is returned due to an incorrect address or failure to collect it, we reserve the right to charge an administrative and handling fee equal to our actual cost (currently 250 SEK, converted at checkout). A new delivery fee will be charged for reshipment.

If an item is out of stock when your order is packed, we will ship the available items and update your order and shipping costs accordingly. You will only be charged for items that are delivered.

If your package arrives damaged or opened, please report this to both the carrier and our customer service immediately (preferably the same day). Keep all original packaging until the matter is fully resolved.

Claims and Warranties

Molimenti follows the Swedish Consumer Agency’s guidelines for e-commerce and inspects every shipment before dispatch. If a product is defective or incorrect, you have the right to make a claim within a reasonable time after discovery – but no later than three (3) years from the purchase date.

According to Swedish law, any defect discovered within six months of purchase is presumed to have existed at the time of delivery, unless proven otherwise. After six months, the burden of proof rests with the customer.

To process a claim, you must retain the defective item and its original packaging until the matter is resolved. Contact our customer service to initiate the process. If the item is out of stock or discontinued, we will notify you before proceeding. Approved claims will be refunded within 30 days.

Right of Withdrawal, Returns and Refunds

You have the right to return your product within 14 days of receiving your order. To be eligible for a return, the product must be unused, unopened, and in its original packaging, including any protective plastic or seals.

In accordance with Swedish law (2005:59), the right of withdrawal does not apply to sealed goods that are not suitable for return due to health or hygiene reasons if the seal has been broken.

You are responsible for packing the product securely when returning it. Approved returns are refunded within 30 days of receipt and inspection.

You also have the right to make a warranty claim within three years of purchase for manufacturing defects or damages that occurred before delivery. Normal wear and tear (such as bristles becoming bent or worn from regular use) is not considered a defect.

Molimenti may first attempt to repair or replace the product. If this is not possible, a refund will be issued. Returns or exchanges can only be made for the original purchase value. Exchanges for more expensive items are not permitted.

We do not accept partial returns of bundles. All items in a bundle must be returned together. Return shipping costs are the customer’s responsibility. A handling fee of 149 SEK will be deducted from the refund.

We reserve the right to wait until the item is returned or until satisfactory proof of return is provided before issuing a refund. Refunds are only issued to the original payment method.

All returns must be pre-approved by our customer service.

International Orders – Customs and Import Charges

We offer international shipping, including to the United States. Please note the following:

Orders shipped outside the EU may be subject to customs duties, VAT, or other import fees.

These charges are not included in the product or shipping price and are the customer's responsibility.

Molimenti has no control over these charges and cannot estimate their amount.

If you refuse a shipment due to customs charges, shipping costs will not be refunded, and any return fees may be deducted from your refund.

We recommend contacting your local customs authority before placing an order.

Liability

Molimenti’s liability for delivery issues is governed by the terms applicable to your order. Our liability is limited to the total value of your order.

We are not responsible for indirect damages or losses resulting from delays or defects, such as lost income or business opportunities. Nor are we liable for delivery failures due to events beyond our control, such as natural disasters, legal restrictions, operational disruptions, or other force majeure events.

Force Majeure

Molimenti is not required to fulfill an order if circumstances beyond our control arise. This includes government actions, legal changes, war, fire, natural disasters, strikes, transportation disruptions, sabotage, supplier failures, or criminal activity affecting Molimenti or its partners.

We are not responsible for changes in products or specifications made by manufacturers or suppliers outside of our control.

Personal Data

When shopping on our website, we collect certain personal data to process your order. We take your privacy seriously and ensure your data is handled securely. You have the right to access, correct, or request deletion of your data. For more information, see our Privacy Policy.

User-Generated Content

Our website may contain user-generated content, including content from social media. Molimenti is not responsible for such content and does not claim ownership of material we have not created. If you believe any content violates your rights or is offensive, please contact our customer service.

Fraud

All fraud attempts will be reported to the authorities. Molimenti reserves the right to cancel any order suspected of fraudulent activity.

Applicable Law and Disputes

These terms and your use of the website are governed by Swedish law. Any dispute shall be resolved exclusively by Swedish courts unless otherwise required by applicable law.

Severability

If any provision of these terms is deemed invalid by a court or authority, the remaining provisions shall remain fully enforceable.

Intellectual Property Rights

All intellectual property rights on this website – including trademarks, copyrights, design, text, and images – are the property of Ombray Media AB or its licensors and may not be used commercially without written permission. Any use of the website’s content, whether in full or in part, beyond private and non-commercial use, is strictly prohibited. Unauthorized use may result in legal action under applicable law.
